Disputes involving construction, the environment, information technology and other industry activities based on science and engineering are common in today's business world. The complex technical and operational requirements of contracts in these areas are often subject to differing interpretations. When the parties to such contracts disagree and cannot resolve their differences in the ordinary course of business, the result is often the genesis of a formal dispute that is ultimately resolved in litigation.
Legis Consultancy, Inc. provides its clients and their attorneys with two distinct services relative to these disputes. The first, Dispute Consulting, provides advice in areas of overall strategy; evaluation of a lawsuit's technical merits; explanation of technical issues and their relationships to the dispute; identification of linkages between technical entitlement and damages; advice as to whether to employ expert witnesses; and if so, what kind of witness to employ; preparation of witnesses; assistance with depositions; preparation of discovery lists; production of demonstrative evidence materials for fact and expert witness testimony; support at settlement negotiations; and related tasks.
The second, Expert Witness Services, provides expert analysis of a particular aspect of the dispute. The expert is generally given a defined scope of inquiry, conducts that inquiry and analysis, and renders a written report. Typically, the expert is later deposed by the opposition relative to his or her findings and opinion and, if the dispute goes to trial, gives his or her testimony before the judge and/or jury.
